Terms of service

These terms apply when you buy from businessstepbystep.co.uk. Please read them before you place an order. If you have any questions, contact us at support@businessstepbystep.co.uk.

1. Who we are

The shop is run by Ismael Giménez Olmos, a sole trader trading as Business Step by Step, of Calle San Juan 29, 03190 Pilar de la Horadada (Alicante), Spain. NIF (Spanish tax ID): 48736486S. Email: support@businessstepbystep.co.uk. In these terms, "we", "us" and "our" mean Ismael Giménez Olmos trading as Business Step by Step, and "you" means the person buying from us.

2. Our products

We sell practical business ebooks, playbooks, checklists, a KPI toolkit and workbooks as PDF files to download, either individually or in packs. They are digital content: nothing is printed or posted. Each product page describes what the product contains, including its page count. The files are A4 PDFs with fonts embedded. To use them you need a device that can open PDF files and, for the packs and the upgrade, unzip a ZIP file.

The upgrade from The Business Library to The Ultimate Business Bundle is intended only for customers who have already bought The Business Library. It contains the 18 products that are not in The Business Library and does not include the 55 ebooks again.

3. Prices and payment

Prices are shown in pounds sterling (GBP). The price you pay is the price shown at checkout when you place your order. We may change our prices at any time, but a change does not affect orders that have already been placed.

Payment is taken through Shopify's checkout and handled by our payment providers. You can pay by card or with the digital wallets offered at checkout. We never see or store your full card details.

4. How the contract is formed

You place an order by adding products to your cart, ticking the consent box described in section 5, completing the checkout and paying. Your order is an offer to buy. The contract between you and us is formed when your payment is accepted and your order is confirmed on the order confirmation page or by order confirmation email, whichever comes first. If we cannot accept your order, for example because payment fails, we will tell you and you will not be charged, or any payment taken will be refunded.

5. Immediate access and your right to cancel

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations, you normally have 14 days to cancel an online purchase. For digital content that is not supplied on a physical medium, that right ends once the supply has begun, if you gave your express consent to immediate supply and acknowledged that you would lose the right.

Before you pay, you must tick a box that says: "I want immediate access to the digital content and I understand that I lose my 14-day right to cancel once the download is available." We confirm your consent and acknowledgement in your order confirmation email. Once the download is available, you can no longer cancel the contract under the 14-day right. If your download has not yet been made available to you, you may still cancel and we will refund you in full. Our refund policy explains this in more detail.

6. Delivery

Immediately after payment, download links appear on the order confirmation page and in the order confirmation email (we use Shopify Digital Products to deliver the files). Please download the files and save them to your device, and keep a backup. Download links may stop working after a time. If a link stops working or is lost, email us with your order number and we will resend it.

7. Your licence to use the products

When you buy a product, we give you a licence to use it. We do not sell you the copyright. Every PDF states: "Licensed for the personal use of the purchaser; not to be copied, shared or resold." This means that:

  • you may download, store, read and print the files for your own personal use, including using what you learn in your own work
  • you may not copy, share, forward, upload, publish, resell, sublicense or otherwise make the files, or substantial parts of them, available to anyone else, including colleagues, clients or students, or put them on a shared drive or network
  • for the workbooks only, you may also photocopy the templates for your own use and within your own organisation

If you break these licence terms, we may end your licence by telling you in writing, and you must then delete your copies. This does not affect any other rights we have.

8. Your statutory rights

If you are a consumer, you have legal rights in relation to digital content that is faulty or not as described. Under the Consumer Rights Act, digital content must be of satisfactory quality, fit for purpose and as described. If it is not, you are entitled to a repair or replacement and, if that is not possible or is not done within a reasonable time and without significant inconvenience to you, to a price reduction, which may be a full refund. If faulty digital content we supplied damages a device or other digital content belonging to you because we did not use reasonable care and skill, we will either repair the damage or compensate you. Nothing in these terms affects these rights. For more information about your rights, contact Citizens Advice.

9. Not professional advice

Our products are for general educational purposes only. They are not legal, financial, tax or professional advice, and they are not a substitute for advice on your particular situation. Laws, tax rules and employment rules change. Where a subject touches on them, check the current position at gov.uk, ACAS or with a suitably qualified professional before you act. The examples in the products feature fictional organisations, and the figures in them are there to show how a method works.

10. Our responsibility to you

If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen, or if, at the time the contract was made, both we and you knew it might happen.

Because our products are learning materials and are not advice, we are not responsible for decisions you make, or for any results you get or do not get, from applying their content. Where the law allows, we are not responsible to you for loss of profit, loss of revenue, loss of business, business interruption or loss of business opportunity. If you buy as a business rather than as a consumer, our total liability to you in connection with an order will not exceed the price you paid for that order.

Nothing in these terms excludes or restricts our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights as a consumer, or for anything else that cannot be excluded or restricted by law.

11. Intellectual property

The products, including their text, tools, templates, diagrams and design, and the content of this website, are protected by copyright and other intellectual property rights, which belong to us or our licensors. Apart from the licence in section 7, no rights are given to you. Methods and frameworks described in the products are credited to the people or organisations who developed them where they are known. Mentioning a name, method or organisation does not mean that it endorses, or is connected with, Business Step by Step.

12. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, such as a failure of the hosting, payment or download services we rely on. If this happens, we will let you know and do what we reasonably can to deliver your files as soon as possible. If the delay is likely to be substantial, you may contact us to cancel your order and receive a refund for any download not yet made available.

13. Your personal data

We use your personal data as described in our privacy policy.

14. Changes to these terms

We may update these terms from time to time. The terms that apply to your order are the ones published on this website when you placed it.

15. Other important terms

If a court or other authority decides that any part of these terms is unlawful, the rest will remain in force. If we do not insist straight away that you do something you are required to do under these terms, we can still require you to do it later. These terms are between you and us, and no one else has any right to enforce them. They are written in English, and the contract is concluded in English.

16. Problems and complaints

If you have a problem or a complaint, please email us first at support@businessstepbystep.co.uk with your order number. We aim to reply within two working days and will try to resolve the matter quickly and fairly.

17. Governing law and courts

These terms are governed by the law of England and Wales. If you are a consumer, this choice of law does not take away the protection you have under the mandatory consumer law of the country where you live, and you may bring legal proceedings in the courts of that country. If you live in Scotland, you can bring proceedings in either the Scottish or the English courts. If you live in Northern Ireland, you can bring proceedings in either the Northern Irish or the English courts. If you buy as a business, the courts of England and Wales have exclusive jurisdiction, unless the law requires otherwise.
